Why was Shane taken down? There is information on a previous thread corroberating that is is in the public domain. The original copyright was filed in 1952, and in the mysterious world of copyright law, it is now under Japanese jurisdiction. Please see the thread

and the articles referenced there.

jonc: I think it is PD only in Japan. I've posted a reply in the previous thread, and just so it's not too confusing, here it is again:

I quote from the Washington University intellectual property newsletter referenced above:

"But, because the United States and Japan are both members of the Berne Convention, in Japan, Shane is under the jurisdiction of the Japanese Copyright Law."

The key words are: "in Japan." Whether or not it is PD in Japan does not make it PD in the United States.

In addition, the underlying literary work has been renewed. From the Stanford copyright renewal database:

itle Shane
Author Jack Schaefer
Registration Date 14Oct49
Renewal Date 26Oct76
Registration Number A37550
Renewal Id R645523
Renewing Entity Jack Schaefer (A)

Plus a quick check of the Library of Congress copyright database (www.copyright.gov/cohm)shows that the film's copyright was renewed as well:

Registration Number: RE-62-117
Title: Shane.
Claimant: Paramount Pictures Corporation (PWH)
Effective Registration Date: 25Jun80
Original Registration Date: 27May53 (in notice: 1952);
Original Registration Number: LP2892.
Original Class: L

Oops, somehow I skimmed right by that. Read it twice, too. I guess it was too good to be true.

Sorry, jonc. And thanks, Skip. D'oh!
